TERMS AND CONDITIONS OF USE

1. PREAMBLE AND IDENTIFICATION OF THE SELLER

This document constitutes the framework agreement between the company and its users/customers. Accessing, visiting, or purchasing products from the website https://www.geko.ro/ implies full acceptance of these terms.

2. DEFINITIONS AND TERMS

  • Seller: GEKO COMERT SRL.

  • Buyer: A natural person (over 18 years old) or legal entity that places an Order.

  • Client: The person who has or obtains access to the CONTENT, through any means of communication made available by GEKO COMERT SRL.

  • Account: The section of the Website consisting of an e-mail address and a password that allows the Buyer to place the Order and which contains information about the Client/Buyer and their history.

  • Specifications: All details regarding the characteristics of the Goods and Services as stated in their description.

  • Transaction: The collection or reimbursement of an amount resulting from the sale of a Good and/or Service by GEKO COMERT SRL.

3. ONLINE SALES POLICY

3.1. Access for the purpose of placing an Order is permitted to any Client/Buyer, except in cases where GEKO COMERT SRL reserves the right to restrict access for justified reasons (abusive conduct, history of unjustifiably refused orders, etc.).

3.2. Communication with the Seller may be carried out through direct interaction with the Seller or through the addresses mentioned in the “Contact” section.

3.3. GEKO COMERT SRL may publish on the Website information regarding Goods and/or Services and/or promotions practiced by it, during a certain period of time and within the limit of available stock.

3.4. All prices related to the Goods and/or Services presented on the Website are expressed in RON and include VAT.

3.5. In the case of online payments, the Seller is not / cannot be held responsible for any additional costs borne by the Buyer, including but not limited to currency conversion fees charged by the issuing bank of their card.

4. THE ORDER AND THE DISTANCE CONTRACT

4.1. The Buyer may place Orders on the Website by adding the desired Goods and/or Services to the shopping cart. Once added to the shopping cart, a Good is available for purchase insofar as stock is available.

4.2. By completing the Order, the Buyer agrees that all data provided by them, necessary for the purchasing process, are correct and complete as of the date the Order is placed.

4.3. Moment of conclusion of the contract: The contract is deemed concluded between the Seller and the Buyer at the moment the Buyer receives the Order shipment notification (by e-mail or SMS). The order receipt notification (immediately after placement) is for informational purposes only and does not represent the automatic acceptance of the contract.

4.4. The Seller may cancel the Order placed by the Buyer, following prior notice, without any further obligation of either party towards the other, in the following cases:

  • The transaction is not accepted by the issuing bank of the Buyer’s card;

  • The transaction is invalidated by the approved card processor;

  • The data provided by the Client/Buyer on the Website are incomplete and/or incorrect.

5. RIGHT OF WITHDRAWAL (RETURN POLICY)

According to Emergency Ordinance no. 34/2014, the Buyer who is a natural person benefits from a period of 14 calendar days to withdraw from a distance contract, without having to justify the withdrawal decision.

5.1. Return period: It begins on the day when the Buyer or a third party indicated by them takes physical possession of the product.

5.2. Return conditions: The product must be in the same condition in which it was delivered, show no signs of wear, impact, or physical modifications, and must have all accessories and the original packaging intact (where possible).

5.3. Costs: The transport cost for the return is borne exclusively by the Buyer, except where the product was delivered defective or incorrectly due to the Seller’s fault.

5.4. Refund of the amount: This will be made within a maximum of 14 days from the date on which the Seller is informed of the withdrawal decision, but not before the physical reception of the returned product for verification. The refund is generally made using the same payment method used for the initial transaction.

6. GOODS/SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL IS NOT PROVIDED

The following are exempt from the right of withdrawal:

  • Products made according to the specifications presented by the Buyer or clearly personalized;

  • Products that are liable to deteriorate or expire rapidly;

  • Sealed products which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the Buyer.

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

7.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, trade symbols, static images, dynamic images, text and/or multimedia content displayed on the Website, are the exclusive property of GEKO COMERT SRL.

7.2. The Client/Buyer is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, display, include any Content in any context other than the original one intended by GEKO COMERT SRL.

8. WARRANTIES AND CONFORMITY

8.1. All Goods sold by GEKO COMERT SRL benefit from warranty conditions compliant with the Romanian legislation in force (Law 449/2003 and Emergency Ordinance 140/2021).

8.2. The Goods are new (unless otherwise specified) and come from sources authorized by each individual manufacturer.

8.3. The absence of the warranty certificate of the Good must be reported within a maximum of 48 hours from the receipt of the Good at the contact address.

9. DELIVERY OF GOODS

9.1. The Seller undertakes to deliver the Goods by door-to-door courier service to the Buyer.

9.2. The Seller shall ensure the proper packaging of the Goods and the transmission of the accompanying documents (invoice, certificates).

9.3. The delivery times displayed on the website are estimated. During peak periods (Black Friday, Holidays), these times may be subject to change.

10. PROCESSING OF PERSONAL DATA (GDPR)

10.1. GEKO COMERT SRL is a personal data controller.

10.2. We collect data such as: first name, last name, phone number, delivery address, e-mail address, billing details.

10.3. Purpose of collection: Validation, shipping and invoicing of orders, resolving cancellations or problems of any kind related to an order, ensuring access to the services offered.

11. FRAUD AND LIMITATION OF LIABILITY

11.1. Any attempt to access another user’s personal data, modify the content of the website, or affect the performance of the server on which the website runs shall be considered an attempt at fraud and shall trigger criminal investigation against the person or persons who initiated such action.

11.2. The Seller cannot be held responsible for damages of any kind that the Buyer or any third party may suffer as a result of using the Website or the products after delivery, especially for the loss of the products or their use contrary to the instructions.

12. DISPUTES AND FINAL PROVISIONS

12.1. This Contract is governed by Romanian law.

12.2. Any disputes arising between GEKO COMERT SRL and Clients/Buyers shall be resolved amicably. If no agreement is reached, the dispute shall be settled by the competent Romanian courts in the Municipality of Bucharest.

12.3. If any of the above clauses is found to be null or invalid, regardless of the cause, such clause shall not affect the validity of the remaining clauses.
